Marcella Rich writes on the Bar Standards Board’s Guidance on the use of Artificial Intelligence and Other Technologies

A global UNESCO Survey of judicial professionals across 96 countries revealed that 44% of legal practitioners and judges use ChatGPT for work, while only 9% have received formal AI training. This huge capability and knowledge gap has resulted in serious ethical, human rights, and legal concerns. 

Against this backdrop, courts have seen an increase in cases involving AI-driven errors particularly “hallucinations” where lawyers cited completely fabricated cases without following proper due diligence while submitting documents. In response professional bodies have introduced stricter rules to promote the safe and responsible use of AI. Notable among these is the recent guidance from the Bar Standards Board (BSB) regarding the safe and responsible use of AI-generated material.

In light of the new guideline, Marcella Rich published an opinion piece on Law360, examining two court cases where AI uses amplified systemic and operational flaws.
